STORAGE TERMS & CONDITIONS
Effective Date: June 1, 2026
Thank you for choosing Eagle Bay Mercantile & Storage. These Terms & Conditions apply to all indoor and outdoor storage services provided by Eagle Bay Mercantile Inc. ("EBM", "we", "our", or "us") and form part of every storage agreement entered into by our customers ("Customer" or "you").
By storing a boat, RV, trailer, vehicle, or other property with Eagle Bay Mercantile & Storage, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
STORAGE ACCESS & HOURS
Storage access and customer service are available during regular business hours:
8:00 AM – 8:00 PM, seven (7) days per week.
Access outside of regular business hours may be available by prior arrangement and is subject to staff availability.
Eagle Bay Mercantile Inc. reserves the right to temporarily restrict access due to weather conditions, maintenance activities, safety concerns, emergencies, or circumstances beyond our control.
MOVE-IN & MOVE-OUT REQUIREMENTS
A minimum of forty-eight (48) hours' notice is required for all vehicle, boat, RV, and trailer drop-offs and pick-ups.
Notice must be provided by email, text message, or other approved communication method.
For weekend pick-ups (Friday, Saturday, Sunday, and statutory holidays), notice must be received no later than 12:00 PM on the preceding Thursday.
Eagle Bay Mercantile Inc. cannot guarantee immediate access to stored units without the required notice.
COMPLIMENTARY STORAGE SERVICES
Each storage term includes:
• One (1) complimentary move-in service.
• One (1) complimentary move-out service.
Additional move-in or move-out requests are subject to a service fee of $50 plus applicable taxes per occurrence.
VALET PICKUP & DELIVERY SERVICES
Valet pickup and delivery services may be available upon request and are subject to scheduling availability.
Applicable service fees will be quoted at the time of booking.
Customers acknowledge that transportation and movement of stored property carries inherent risks and authorize Eagle Bay Mercantile Inc. and its representatives to move the unit as necessary to provide the requested service.
CUSTOMER RESPONSIBILITIES
The Customer represents and warrants that:
• They are the legal owner of the stored property or have legal authority to store it.
• The unit is safe, roadworthy (where applicable), and in good operating condition.
• The unit is free from hazardous conditions that may endanger persons or property.
• All required registrations, licenses, and insurance remain current during the storage period.
The Customer is solely responsible for:
• Winterization and de-winterization.
• Battery maintenance.
• Fluid levels and mechanical maintenance.
• Pest prevention.
• Security of personal belongings left within the unit.
INSURANCE REQUIREMENTS
Customers are required to maintain comprehensive insurance coverage on all stored property for the duration of the storage term.
Insurance coverage should include protection against theft, fire, vandalism, weather damage, collision, and other risks appropriate to the stored property.
Proof of insurance may be requested at any time.
Eagle Bay Mercantile Inc. does not provide insurance coverage for customer property.
PROHIBITED ITEMS
The following items may not be stored on the property:
• Explosives or ammunition.
• Firearms not stored in accordance with applicable law.
• Hazardous chemicals or toxic substances.
• Flammable liquids in excess of normal vehicle or boat fuel tanks.
• Illegal drugs or contraband.
• Perishable food.
• Any material that may create a safety, environmental, or legal concern.
Eagle Bay Mercantile Inc. reserves the right to refuse or terminate storage services for any property that violates these requirements.
LIMITATION OF LIABILITY
All property is stored entirely at the Customer's sole risk.
To the maximum extent permitted by law, Eagle Bay Mercantile & Storage shall not be liable for any loss, theft, damage, deterioration, depreciation, or destruction of stored property arising from any cause whatsoever, including but not limited to:
• Theft or attempted theft.
• Fire.
• Vandalism.
• Rodents, insects, birds, or other pests.
• Mold, mildew, rust, corrosion, or moisture.
• Wind, rain, snow, flooding, hail, lightning, or other weather events.
• Falling trees, branches, debris, or other natural hazards.
• Acts of God.
• Mechanical failure.
• Battery failure.
• Freezing or winter-related damage.
• Power outages.
• Actions of third parties.
The Customer releases and agrees to hold harmless Eagle Bay Mercantile Inc., its owners, directors, employees, contractors, and agents from any claims, damages, losses, costs, or expenses arising from the storage of the Customer's property.
VEHICLE MOVEMENT AUTHORIZATION
The Customer authorizes Eagle Bay Mercantile Inc. staff to move, reposition, start, tow, boost, or otherwise relocate the stored unit as reasonably required for storage operations, maintenance, emergency situations, customer service, or access to surrounding units.
Eagle Bay Mercantile Inc. shall not be responsible for mechanical issues arising from normal movement or handling of stored property.
PAYMENT TERMS
Storage fees are due on the invoice due date.
Accounts not paid by the due date may be subject to:
• Late payment charges.
• Suspension of storage services.
• Denial of access to stored property.
• Collection activity as permitted by law.
The Customer is responsible for all costs incurred by Eagle Bay Mercantile Inc. in collecting overdue accounts, including collection fees, legal fees, and administrative costs where permitted by law.
ABANDONED OR UNCLAIMED PROPERTY
Property remaining in storage after the expiration or termination of the storage agreement may be deemed abandoned if the Customer fails to make payment arrangements or respond to communications within a reasonable period.
Eagle Bay Mercantile Inc. reserves all rights available under applicable British Columbia laws regarding the handling, removal, disposal, storage, or sale of abandoned property in order to recover outstanding amounts owed.
The Customer remains responsible for all outstanding fees and costs incurred.
TERMINATION OF STORAGE SERVICES
Eagle Bay Mercantile Inc. may terminate storage services immediately if:
• The Customer breaches these Terms & Conditions.
• Required payments are not made.
• The stored property presents a safety risk.
• The Customer provides false or misleading information.
• Continued storage would violate applicable laws or regulations.
INDEMNIFICATION
The Customer agrees to indemnify and hold harmless Eagle Bay Mercantile Inc., its owners, employees, contractors, and agents from any claims, damages, liabilities, losses, fines, penalties, or expenses arising from:
• The Customer's use of storage services.
• The condition of the stored property.
• Any injury or damage caused by the Customer's property.
• Any breach of these Terms & Conditions.
CHANGES TO TERMS
Eagle Bay Mercantile Inc. reserves the right to amend these Terms & Conditions at any time.
The most current version will be posted on our website and shall become effective upon posting.
GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the applicable laws of Canada.
